Welcome to https://elixir.security (together with its subdomains, content and services, the "Site"), operated by Elixir Security Inc. and its affiliates ("Elixir", "we", "our" or "us"). These Terms of Use (the "Terms") govern your access to and use of the Site. Our Privacy Policy is part of these Terms.

By accessing or using the Site, you agree to these Terms. If you use the Site on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and "you" refers to both you and that organization. If you do not agree, do not use the Site.

1. Changes to these Terms

We may change these Terms at any time by posting the updated version on the Site and updating the date above. If a change is significant, we will post a prominent notice on the Site. Your continued use of the Site after a change takes effect means you accept the updated Terms.

2. Eligibility

The Site is intended for people aged 18 or older. If you are under 18, please do not use the Site.

3. Access to the Site

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable right to access and use the Site for your own information and to evaluate Elixir for your business. We grant you no other rights.

4. Restrictions

You must not, and must not allow anyone else to:

• copy, sell, rent, distribute or otherwise make the Site available to others, except as these Terms allow;
• modify, translate, decompile, disassemble or reverse engineer the Site, or try to discover its source code or underlying structure;
• remove or obscure any copyright, trademark or other proprietary notice;
• probe, scan or test the Site's vulnerabilities, or circumvent or interfere with its security features, without our prior written permission;
• upload or transmit viruses, malware or other harmful code;
• access the Site with bots, scrapers or other automated means, or place an unreasonable load on its infrastructure;
• use the Site to build or improve a competing product or service;
• impersonate anyone or misrepresent your affiliation with anyone; or
• use the Site in any way that is illegal, fraudulent, harmful or infringes anyone's rights.

If you believe you have found a security vulnerability in the Site, please report it to contact@elixir.security instead of testing it further.

5. Intellectual property

The Site and its content, including text, graphics, software, designs, and the Elixir name, logo and other trademarks, are owned by Elixir or its licensors and are protected by intellectual property laws. Other trademarks on the Site belong to their respective owners. We reserve all rights not expressly granted in these Terms.

Content on the Site is provided for your information only. You may not use, copy, publish or distribute it for any other purpose without our prior written consent. To ask for permission, contact contact@elixir.security.

6. Feedback

If you send us questions, comments, suggestions or ideas about the Site or our products ("Feedback"), you agree that we may use it for any purpose without restriction or payment to you, and you assign to us any rights you have in it. We are not required to use any Feedback.

7. Linking to the Site

You may link to pages of the Site as long as the link is accurate and does not suggest that we endorse you or are affiliated with you without our consent, and the linking website does not contain unlawful or infringing content.

8. Accuracy of information

We try to keep the Site accurate, but we do not promise that its content is complete, current or error-free. We may change it at any time without notice. Descriptions of products, features or plans are for general information only and are not a commitment that they are or will become available.

9. Third-party content and links

The Site may link to or display content from third parties that we do not control. We do not endorse and are not responsible for third-party content, services, terms or privacy practices. Please read their terms and policies before using them.

We handle personal information collected through the Site as described in our Privacy Policy.

11. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OR QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE OR FREE OF VIRUSES, OR THAT IT WILL MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELIXIR AND ITS AFFILIATES, LICENSORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, REPUTATION OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED US $5.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnity

You agree to defend, indemnify and hold harmless Elixir, its affiliates and their officers, directors, employees and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your use of the Site or your breach of these Terms.

14. Suspension and termination

We may suspend or end your access to the Site, or change or discontinue the Site, at any time, for any reason, without notice or liability. You may stop using the Site at any time. Sections 4 through 16 survive any termination of these Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of the State of Israel, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The competent courts of Tel Aviv-Yafo, Israel have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site.

16. General

• Severability. If any provision of these Terms is found unenforceable, the rest remain in effect, and the provision is replaced with an enforceable one that comes closest to its intent.
• No waiver. Our failure or delay in enforcing any provision is not a waiver of it.
• Assignment. You may not transfer these Terms without our prior written consent. We may transfer them at any time without notice.
• Relationship. These Terms do not create any partnership, joint venture, agency or employment relationship between you and Elixir.
• Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Elixir about the Site, and replace any earlier understandings about it.
